		<title>Nevada Athletics On Probation For Major NCAA Rule Violations</title>

		<content type="html">&lt;span style="font-family: verdana; font-size: 13px; "&gt;RENO, Nev. -- &lt;/span&gt;&lt;a href="http://sports.espn.go.com/ncaa/news/story?id=5007131"&gt;&lt;strong&gt;&lt;span style="font-family: verdana; font-size: 13px; "&gt;The NCAA placed the University of Nevada on probation&lt;/span&gt;&lt;/strong&gt;&lt;/a&gt;&lt;span style="font-family: verdana; font-size: 13px; "&gt; for three years due to major violations of NCAA rules by ex-golf coach Rich Merritt.  Penalties imposed were: &lt;br /&gt;
&lt;br /&gt;
-Public reprimand and censure; &lt;br /&gt;
&lt;br /&gt;
&lt;strong&gt;-&lt;/strong&gt;Three years of probation; &lt;br /&gt;
&lt;br /&gt;
-Reduction in scholarships in men's golf to 4.0 for the 2011-12 and 2012-13 academic years; &lt;br /&gt;
&lt;br /&gt;
-Reduction in scholarships in women's golf to 5.5 for the 2011-12 and 2012-13 academic years; &lt;br /&gt;
&lt;br /&gt;
-The institution shall pay a fine of $1,500 to the NCAA; &lt;br /&gt;
&lt;br /&gt;
&lt;strong&gt;-&lt;/strong&gt;Show-cause order placed on the former head men's golf coach for a period of two years; &lt;br /&gt;
&lt;br /&gt;
-Annual compliance reporting required. &lt;br /&gt;
&lt;br /&gt;

Rich Merritt was &lt;span style="text-decoration: underline; "&gt;NOT CLEARED&lt;/span&gt; of gambling charges.&lt;/strong&gt;  &lt;br /&gt;
&lt;br /&gt;
He refused to cooperate in the NCAA investigation pertaining to the sports betting charges.  &lt;br /&gt;
&lt;br /&gt;
Therefore he was charged with unethical conduct for failure to cooperate and for providing false and misleading information to the NCAA.&lt;br /&gt;
&lt;br /&gt;
"On June 6, 2008, when requested to do so by the enforcement staff,&lt;strong&gt; &lt;/strong&gt;the former head coach &lt;strong&gt;refused to provide access to records of all his credit card transactions&lt;/strong&gt; during his tenure.  &lt;br /&gt;
&lt;br /&gt;
&lt;strong&gt;The records were requested as part of the enforcement staff's investigation into allegations that Merritt &lt;span style="text-decoration: underline; "&gt;wagered on sports&lt;/span&gt;&lt;/strong&gt; during his tenure as head men's golf coach."&lt;br /&gt;
&lt;br /&gt;
The Show-Cause penalty essentially restricts Merritt from working in the NCAA for two years.  &lt;br /&gt;
&lt;br /&gt;
&lt;/span&gt;&lt;span style="font-family: verdana; "&gt;&lt;span style="font-size: 13px; "&gt;&lt;strong&gt; ----------------------------------------------------------------------------------------------&lt;br /&gt;
Here is more on Rich Merritt's (and his father's) violations:&lt;br /&gt;
&lt;/strong&gt;&lt;br /&gt;
-Impermissible provision of airline ticket for student-athlete; &lt;br /&gt;
&lt;br /&gt;
-Impermissible provision of cash to student-athletes; &lt;br /&gt;
&lt;br /&gt;
-Providing alcoholic beverages to student-athletes; &lt;br /&gt;
&lt;br /&gt;
-Provision of impermissible transportation, lodging, meals and complimentary golf; &lt;br /&gt;
&lt;br /&gt;
-Unethical conduct for the head men's golf coach for providing false and misleading information &lt;br /&gt;
&lt;br /&gt;
-A failure to cooperate and promote an atmosphere of compliance. &lt;br /&gt;
&lt;br /&gt;
Merritt oversaw both the men's and women's program&lt;strong&gt; &lt;/strong&gt;during the period in which the violations occurred. The former women's golf coach was &lt;strong&gt;&lt;span style="text-decoration: underline; "&gt;not&lt;/span&gt;&lt;/strong&gt; implicated in any of these violations in her position as head coach. &lt;br /&gt;
&lt;/span&gt;&lt;br /&gt;
&lt;span style="font-size: 13px; "&gt;
&lt;p&gt;&lt;span style="font-family: 'times new roman'; font-size: 16px; "&gt;&lt;span style="font-family: verdana; font-size: 13px; "&gt;This was Nevada's second major infractions case, the other case dating back to 1976.&lt;/span&gt; &lt;br /&gt;
&lt;br /&gt;
&lt;span style="font-family: verdana; font-size: 13px; "&gt;Of note, this is also the second institution that &lt;a href="http://blog.terri-patraw.org/"&gt;&lt;strong&gt;Athletic Director Cary Groth&lt;/strong&gt;&lt;/a&gt; has put on probation for major violations of NCAA rules. The other being Northern Illinois University.  &lt;/span&gt;&lt;br /&gt;

But it is not just the corruption itself that has these good people up in arms, it is the fact that &lt;st1:stockticker w:st="on"&gt;UNR&lt;/st1:stockticker&gt; officials have seemingly been above the law, and have been able to sway the State, news media and even stay out of local courts despite the evidence against them.&lt;span style="font-size: 13px; "&gt;  &lt;/span&gt;&lt;span style="font-size: 13px; "&gt;  &lt;/span&gt;&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin-top: 0in; margin-right: 0in; margin-bottom: 0pt; margin-left: 0in; text-align: justify; " class="MsoNormal"&gt;&lt;o:p&gt;&lt;span style="font-family: verdana; font-size: 13px; "&gt; &lt;/span&gt;&lt;/o:p&gt;&lt;/p&gt;
&lt;p style="margin-top: 0in; margin-right: 0in; margin-bottom: 0pt; margin-left: 0in; text-align: justify; " class="MsoNormal"&gt;&lt;span style="font-family: verdana; font-size: 13px; "&gt;The Grand Jury was requested to hear evidence of this major corruption case involving officials at &lt;st1:stockticker w:st="on"&gt;UNR&lt;/st1:stockticker&gt; based on testimony by citizens at an evidentiary hearing in the Second Judicial District Court on &lt;st1:date w:st="on" month="9" day="17" year="2009"&gt;September 17-18, 2009&lt;/st1:date&gt;. In addition to the testimony, which covered only a small sampling of the evidence, the citizens submitted over 5,000 documents of supporting evidence. This evidence purportedly shows that &lt;st1:place w:st="on"&gt;&lt;st1:state w:st="on"&gt;Nevada&lt;/st1:state&gt;&lt;/st1:place&gt; taxpayers have been defrauded out of millions of dollars and that &lt;st1:stockticker w:st="on"&gt;UNR&lt;/st1:stockticker&gt; has tried for years to keep these crimes from the public.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin-top: 0in; margin-right: 0in; margin-bottom: 0pt; margin-left: 0in; text-align: justify; " class="MsoNormal"&gt;&lt;o:p&gt;&lt;span style="font-family: verdana; font-size: 13px; "&gt; &lt;/span&gt;&lt;/o:p&gt;&lt;/p&gt;
&lt;p style="margin-top: 0in; margin-right: 0in; margin-bottom: 0pt; margin-left: 0in; text-align: justify; " class="MsoNormal"&gt;&lt;span style="font-family: verdana; font-size: 13px; "&gt;Ron Cuzze, President of the Nevada Law Enforcement Officers’ Association (NSLEOA) said “The Nevada Law Enforcement Officers’ Association represents members working for the University of Nevada Reno Police Department. However, we fully recognize that this is a major issue of public corruption which reaches far beyond UNR PD alone, one which affects our local communities, taxpayers throughout the state, leaders and legislators, as well as the ethical image and integrity of the University system and the State of Nevada.  &lt;/span&gt;&lt;span style="color: #2a4f83; "&gt;&lt;strong&gt;&lt;span style="font-family: verdana; font-size: 13px; "&gt;Nevada cannot bow to political pressure and allow this corruption to be swept under the carpet." &lt;span style="font-size: 13px; color: #4b6682; "&gt; &lt;/span&gt;&lt;/span&gt;&lt;/strong&gt;&lt;span style="color: #2a4f83; "&gt;&lt;strong&gt;&lt;span style="font-family: verdana; font-size: 13px; "&gt;&lt;span style="font-size: 13px; color: #4b6682; "&gt;&lt;span style="font-size: 13px; "&gt; &lt;/span&gt;&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;br /&gt;

&lt;p style="margin-top: 0in; margin-right: 0in; margin-bottom: 0pt; margin-left: 0in; text-align: justify; " class="MsoNormal"&gt;&lt;span style="font-family: verdana; font-size: 13px; "&gt;&lt;st1:stockticker w:st="on"&gt;UNR&lt;/st1:stockticker&gt; was characterized throughout the hearing as a RICO crime operation or network. Evidence allegedly revealed that various departments at &lt;st1:stockticker w:st="on"&gt;UNR&lt;/st1:stockticker&gt; are working together in a criminal manner to cover up crimes and to retaliate against those who report crimes, with the full knowledge, approval, and coordination of the President's Office. Other state and local agencies were also implicated in the conspiracies and cover ups.&lt;br /&gt;

&lt;p style="margin-top: 0in; margin-right: 0in; margin-bottom: 0pt; margin-left: 0in; text-align: justify; " class="MsoNormal"&gt;&lt;span style="font-family: verdana; font-size: 13px; "&gt;Other citizen action groups and organizations have also come forward on the issue. Lee Rowland, Attorney for the American Civil Liberties Union stated, &lt;/span&gt;&lt;span style="color: #2a4f83; "&gt;&lt;strong&gt;&lt;span style="font-family: verdana; font-size: 13px; "&gt;"The ACLU has also expressed concern that certain actions taken by UNR officials may violate the First Amendment rights to access public forum space, to petition the courts, and to advocate on serious issues of public policy, including public corruption." &lt;/span&gt;&lt;/strong&gt;&lt;span style="color: #2a4f83; "&gt;&lt;br /&gt;
&lt;/span&gt;&lt;/span&gt;&lt;span style="font-family: verdana; font-size: 13px; "&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;o:p&gt; &lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin-top: 0in; margin-right: 0in; margin-bottom: 0pt; margin-left: 0in; text-align: justify; " class="MsoNormal"&gt;&lt;span style="font-family: verdana; font-size: 13px; "&gt;Additionally, the Reno Outreach for Animal Rights (ROAR) is supportive of the efforts to convene a grand jury investigation of &lt;st1:stockticker w:st="on"&gt;UNR&lt;/st1:stockticker&gt;.  They have expressed great concern regarding allegations of animal abuse and animal abuse for profit at UNR, including the police K-9 program. &lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin-top: 0in; margin-right: 0in; margin-bottom: 0pt; margin-left: 0in; text-align: justify; " class="MsoNormal"&gt;&lt;span style="font-family: verdana; font-size: 13px; "&gt; &lt;/span&gt;&lt;/p&gt;
&lt;p style="margin-top: 0in; margin-right: 0in; margin-bottom: 0pt; margin-left: 0in; text-align: justify; " class="MsoNormal"&gt;&lt;span style="font-family: verdana; font-size: 13px; "&gt;On &lt;st1:date w:st="on" month="10" day="15" year="2009"&gt;October 15, 2009&lt;/st1:date&gt;, Sergeant Lane Grow of &lt;st1:stockticker w:st="on"&gt;UNR&lt;/st1:stockticker&gt; PD was reinstated with back pay at a hearing with State Personnel, after he had been wrongfully terminated by the University and &lt;st1:stockticker w:st="on"&gt;UNR&lt;/st1:stockticker&gt; Police Chief Garcia in retaliation for speaking out.&lt;span style="font-size: 13px; "&gt;  &lt;/span&gt;Ron Cuzze stated &lt;/span&gt;&lt;span style="font-family: verdana; font-size: 13px; "&gt;&lt;span style="font-size: 13px; color: #2a4f83; "&gt;&lt;strong&gt;"Employees who have been harassed and derided by corrupt UNR officials are finally receiving justice and the attention they deserve, but it has been a long, hard road for them to travel."  &lt;br /&gt;

&lt;p style="margin-top: 0in; margin-right: 0in; margin-bottom: 0pt; margin-left: 0in; text-align: justify; " class="MsoNormal"&gt;&lt;span style="font-family: verdana; font-size: 13px; "&gt;&lt;span style="font-size: 13px; "&gt;Judge &lt;/span&gt;Connie Steinheimer in Department 4 recently issued an order with findings that there is enough evidence to convene a Grand Jury investigation of &lt;st1:stockticker w:st="on"&gt;UNR&lt;/st1:stockticker&gt;.  Through a Grand Jury investigation, criminal indictments may be sought against&lt;span style="font-size: 13px; "&gt; &lt;st1:stockticker w:st="on"&gt;UNR&lt;/st1:stockticker&gt; President Milton Glick, Chief of Police Adam Garcia, Athletic Director Cary Groth, General Counsel Mary Dugan, and several other &lt;st1:stockticker w:st="on"&gt;UNR&lt;/st1:stockticker&gt; Officials. &lt;st1:stockticker w:st="on"&gt;UNR&lt;/st1:stockticker&gt; spokespersons Jane Tors and private attorney Kent Robison&lt;/span&gt; are also implicated in the criminal allegations.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin-top: 0in; margin-right: 0in; margin-bottom: 0pt; margin-left: 0in; text-align: justify; " class="MsoNormal"&gt;&lt;o:p&gt;&lt;span style="font-family: verdana; font-size: 13px; "&gt; &lt;/span&gt;&lt;/o:p&gt;&lt;/p&gt;
&lt;p style="margin-top: 0in; margin-right: 0in; margin-bottom: 0pt; margin-left: 0in; text-align: justify; " class="MsoNormal"&gt;&lt;span style="font-family: verdana; font-size: 13px; "&gt;It is noted that previously two citizens and a member of the NSLEOA attempted to bring this case to the Grand Jury in &lt;st1:place w:st="on"&gt;Washoe County&lt;/st1:place&gt;, but were denied by the District Court.  The information was then sent to the Nevada Supreme Court, which subsequently ordered the lower court to conduct the formal hearings in September.  If reasonable evidence was brought forth, the District Court was ordered by the Supreme Court to impanel the Grand Jury.&lt;o:p&gt;&lt;/o:p&gt;&lt;/span&gt;&lt;/p&gt;
&lt;p style="margin-top: 0in; margin-right: 0in; margin-bottom: 0pt; margin-left: 0in; text-align: justify; " class="MsoNormal"&gt;&lt;o:p&gt;&lt;/o:p&gt;&lt;span style="font-family: verdana; font-size: 13px; "&gt; &lt;/span&gt;&lt;/p&gt;
